Terms of Service

1. Acceptance of Terms

By accessing or using Nexa Automations ("the Service"), operated by Pinnacle Peak Workflow Solutions ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Nexa Automations provides AI-powered automation bots deployed on cloud infrastructure. Each customer receives a personalized AI assistant accessible via Telegram that can manage data, run scheduled tasks, and integrate with third-party services on the customer's behalf.

3. Account Terms

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • Accounts are created by Pinnacle Peak Workflow Solutions on your behalf. You may not create accounts yourself.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe upon the rights of others.
  • Transmit any malicious code, spam, or harmful content.
  • Attempt to gain unauthorized access to other systems or networks.
  • Use the AI bots for any illegal, fraudulent, or abusive purposes.
  • Reverse-engineer or attempt to extract the source code of the Service.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.

  • You retain ownership of all data you provide to the Service.
  • We store and process your data on AWS infrastructure in the United States.
  • Your bot interactions and data are isolated from other customers.
  • We do not sell your data to third parties.

6. Third-Party Services

The Service integrates with third-party platforms including but not limited to Telegram, AWS, and Notion. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or reliability of third-party services.

7. Payment and Billing

  • Fees for the Service are as quoted in your service agreement.
  • AWS infrastructure costs incurred by your bot are your responsibility.
  • We reserve the right to change pricing with 30 days' notice.
  • Failure to pay may result in suspension or termination of your account.

8. Termination

Either party may terminate the service at any time. Upon termination:

  • Your bot will be stopped and cloud resources will be deprovisioned.
  • You may request an export of your data within 30 days of termination.
  • After 30 days, your data will be permanently deleted.
  • We may terminate your account immediately if you violate these terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINNACLE PEAK WORKFLOW SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
